If you are married to a United States Citizen and entered the country legally you might be eligible to file for your green card at the same time you file your I-130 petition. This is true even if your status has expired and you’ve been living in the United States without legal status.

Your green card is proof of your status as a permanent resident in the United States. That status never expires, even though your card might.
