Relative Petition
(I-130)

General Eligibility (exceptions apply) for Immediate Visa if you are the:

  • Spouse of a United States Citizen;

  • Unmarried child of a United States Citizen and you’re under 21 years old; or

  • Parent of a United States Citizen and your child is over 21 years old.

General Eligibility (exceptions apply) for Visa once Priority Date is Current if you are the:

  • Unmarried child of a United States Citizen and you’re over 21 years old;

  • Married child of a United States Citizen;

  • Brother or sister of a United States Citizen and they’re over 21 years old;

  • Spouse of a Lawful Permanent Resident; or

  • Unmarried child of a Lawful Permanent Resident.

Priority Dates

  • These dates apply to immigrants who are not immediate relatives of United States Citizens. Because the government has put a cap on the number of these people who can immigrate, they have to wait until their priority date is current before they can immigrate. An individual’s priority date depends a number of factors and can result in a long waiting period.

Determining whether you’re eligible for this form of relief is complicated. Please schedule a consultation if you think you might eligible.
