General Eligibility (exceptions apply) for Immediate Visa if you are the:

Spouse of a United States Citizen;

Unmarried child of a United States Citizen and you’re under 21 years old; or
-
Parent of a United States Citizen and your child is over 21 years old.
General Eligibility (exceptions apply) for Visa once Priority Date is Current if you are the:

Unmarried child of a United States Citizen and you’re over 21 years old;
-
Married child of a United States Citizen;
-
Brother or sister of a United States Citizen and they’re over 21 years old;
-
Spouse of a Lawful Permanent Resident; or
-
Unmarried child of a Lawful Permanent Resident.
Priority Dates

These dates apply to immigrants who are not immediate relatives of United States Citizens. Because the government has put a cap on the number of these people who can immigrate, they have to wait until their priority date is current before they can immigrate. An individual’s priority date depends a number of factors and can result in a long waiting period.
